VERIFY: Are local officials enforcing texting while driving ban?

HOUSTON — You probably see it all the time on the roads: Drivers on their phones texting while behind the wheel.

Don’t do it! It became illegal in Texas two years ago.

Viewer Jon Gray had questions about the law and reached out to our Verify team. He asked if it is illegal, why is it not being enforced by local officials?

We reached out to Kese Smith, a spokesperson with the Houston Police Department. We can verify yes, officers are enforcing the texting while driving law.

However, there is difficulty with doing it. Smith said it's because it's a crime that requires a witness and does not need to involve another traffic violation for a citation to be issued. Plus, it's dangerous, so just put down those phones!
