Attorneys for Houston transplant surgeon close to an agreement on restraining order with families seeking legal recourse

The families of three men who died while waiting on liver transplants are seeking a restraining order to prevent the surgeon from destroying evidence.

HOUSTON — The attorneys representing several families seeking a restraining order against Houston surgeon Dr. Steve Bynon said they had come to an agreement Thursday with attorneys representing the embattled doctor.

Bynon previously presided over the liver transplant program at Memorial Hermann, which was recently put on pause due to “irregularities.”

The families of three men who died while waiting on liver transplants at the hospital spoke out Wednesday. Their legal representatives with the Hastings Law Firm announced they would pursue a temporary restraining order (TRO) against Bynon.

The TRO would prevent Bynon from deleting or destroying critical evidence that could help show if the families’ loved ones were improperly denied transplants.

In court Thursday, a judge was scheduled to hear arguments about the order. However, attorneys for both sides stated they were close to an agreement regarding the restraining order.

Attorney Tom Hastings said the exact language was still being decided but he believed both sides agreed on the “principle of the matter.”

Bynon’s legal representative Matt McCracken told a judge that both sides planned to come up with something “mutually agreeable.”
