Man accused of taking a break from his video game to rape a teenager

Another gamer overheard the incident, telling deputies he heard the victim cry out in distress and clearly say "no."

NEW PORT RICHEY, FL -- An 18-year-old man took a break from a video game so he could rape an underaged girl, Pasco County, Florida, deputies say.

Daniel Enrique Fabian was playing the game Grand Theft Auto on his PlayStation 4 when he told another gamer he was going to "smash" a 15-year-old girl, the police report states.

The witness told investigators he understand "smash" to mean "have sex."

Deputies say Fabian stopped playing the game for approximately 15 minutes, but he remained logged in on the gaming console with his microphone still on.

The other gamer with whom he was playing GTA with at the time overheard the incident, telling deputies he heard the victim cry out in distress and clearly say "no."

The 15-year-old victim later told investigators she tried to stop the assault four times. She claims Fabian put his hand over her mouth, pushed her down onto his bed and raped her.

Fabian was arrested after a Sexual Assault Victim Exam provided a DNA match. He's now charged with lewd and lascivious battery on a victim between the age of 12 and 15.
