Major crash in Katy leaves one child dead, another critically injured

Deputies said it does not appear that the children were property restrained although there were booster seats in the car.

KATY, Texas — A child is dead and another is critically injured after a major two-vehicle accident in Katy Friday night.

It happened at about 9:30 p.m. in the 2250 block of Morton Ranch Road. 

The Harris County Sheriff's Office said Jose Chavez was driving with wife and three kids when they were struck by a Camaro when he attempted to make a left turn on Elrod Road. 

The couple's 6-year-old son, identified as Elijah Chavez, died at the hospital. 

3-year-old Nora Chavez was ejected from the car on impact. She was transported to Memorial Hermann and remains there in critical condition.

Ella Chavez, 4, and her parents at the hospital and is said to be stable. 

The driver of the Camaro, later identified as Rafael Quiroz, was not injured.

Quiroz told deputies he had a yellow light when he entered the intersection. Chavez stated he had a flashing yellow arrow when he approached the intersection. According to deputies, this would indicate a failure to yield the right of way on Mr. Chavez part, but deputies also said Quiroz was speeding. 

Deputies also said it does not appear that the children were properly restrained although there were booster seats in the car.

The cause of the crash is under investigation.  

At this time it is not clear if the parents will be charged for not properly securing the children. The case will be presented to the District Attorney's Office.
