Judge says there's not enough evidence to charge wife of contractor accused of stealing from clients

A judge said there wasn't enough evidence to charge Andrea Miller and told prosecutors to bring forth more evidence to a grand jury.

HARRIS COUNTY, Texas — A contractor accused of stealing nearly $200,000 from several Houston customers remains in jail while charges against his wife are in limbo.

On Tuesday, a judge in the case said there's not enough proof to charge Andrea Miller with aggregate theft. The judge told prosecutors they needed to present more evidence to a grand jury to move forward with charges.

Aleck Miller is still in jail and facing two counts of aggregate theft and one count of theft from an elderly person. His total bond was set at $75,000.

The Katy couple owns AM2 Construction and stole from clients in Katy, Sugar Land, Cypress and Friendswood, according to court documents.

Prosecutors said the Millers took money for work that was never completed and spent the money gambling at casinos.

According to court records, Aleck and Andrea Miller spent more than $1.5 million at casinos after they were hired for the projects.

At least eight clients, including two elderly couples, have come forward with similar stories. The victims said they lost nearly $200,000 total to the Millers, according to prosecutors.

According to charging documents, clients hired the couple for home renovation projects, like installing backyard patios and outdoor kitchens. Prosecutors said the Millers would require thousands of dollars in down payments and sometimes ask for more money for materials. The victims said he'd blame delays on things like medical emergencies, including a heart attack, and then the couple would ghost them.

They found evidence that Aleck Miller spent over $1.4 million, including money from the clients, at gaming tables and slots in Louisiana, Mississippi and Reno between April 2022 and March 2023. Andrea Miller spent nearly $110,000 at gaming tables and slots between April and December 2023, according to court records.

According to prosecutors, Aleck Miller also has a 1999 felony theft conviction in Harris County.
