'She deserves more': Woman charged with tampering with evidence after accidental shooting

District Attorney Joshua Phanco said Damper showed a level of recklessness the night of the shooting and Tuesday's court hearing was just a precursor to a bigger bond hearing.

HOUSTON — A woman accused of accidentally shooting a male in the head Sunday appeared in court Tuesday for trying to rub off the gunshot residue after the shooting.

Cassandra Nickcole Damper is charged with tampering/fabricating of evidence.

Family and friends accompanied Damper to court. They covered her face with purses and jackets as she walked in. The judge gave her a $2500 bond and scheduled her next court date for May 8. She left in tears.

District Attorney Joshua Phanco said Damper showed a level of recklessness the night of the shooting and Tuesday's court hearing was just a precursor to a bigger bond hearing.

"I have no doubt that more charges will be on the way," said Phanco.

Devyn Holmes, the man who was shot, is still in the hospital fighting for his life.

Holmes' mother, Sheree Homles, was in court to see that justice was served. When she got the news her son had been shot she thought it was an April Fool's joke.

"I was still hoping it was a joke when I got to the hospital, like maybe the doctors are in on it too," said Sheree. "But it wasn't."

Sheree said she was upset with the charge and bond given to Damper and thinks the shooting was intentional. She said Holmes is stable and they are waiting for more results on his condition.

"He didn't deserve this and she deserves more than what she is getting," said Sheree.

Sunday morning around 2:25 a.m., Damper, Holmes and another man were sitting in a car in front of a Valero gas station on the 5200 block of Almeda Road. The three of them were playing with two pistols and Damper accidently shot Holmes in the head, according to the Houston Police Department.

When police arrived on scene they detained Damper and the other male for questioning. Officers bagged their hands so they could be tested for gunshot residue. Damper attempted to wipe off the residue that may have been present, according to police.

Damper was arrested on scene for attempering to destroy evidence.

Phanco said the other man that was in the vehicle has been very cooperative with authorities.
