MONTGOMERY COUNTY, Texas — Several KHOU 11 viewers have submitted questions to our Verify team about whether you can legally buy and sell a pet on the side of the road.
Viewer Robin said she always spots puppies being sold on the side of the road in Montgomery County.
We talked to Montgomery County attorney B.D. Griffin, and we can verify it is legal, just not everywhere.
Griffin said under current Texas law, Montgomery County cannot enact an ordinance to ban the selling of animals by roadside vendors. Counties with a population of more than 1.3 million do have the authority to ban roadside sales.
In Harris County, roadside sales are illegal.
Some cities in Montgomery County also have a ban in place. But when we're talking the entire county with all the unincorporated areas, selling animals on the side of the road in Montgomery County is OK.
