A Harris County Judge has dismissed one of two charges against anti-Planned Parenthood activist David Daleiden.

Daleiden faced two charges: one misdemeanor for the purchase and sale of human organs and a felony for tampering with government ID. The misdemeanor charge was dropped Monday, but he is still facing the felony charge.

Daleiden wrote on Twitter, "Pleased to announce the first sham indictment against me in Houston, TX has been dismissed: @PPGulfCoast @PPact #QED"

On Tuesday, the Harris County District Attorney's Office said they will not fight the judge's decision and will instead focus on prosecuting the felony charge. A hearing has been set for July.

Daleiden is accused of heading an undercover video investigation into Planned Parenthood, accusing the organization of fetal parts trafficking. He was indicted in January.
