CONROE, Texas – Conroe police are investigating a shooting on Silver Creek Drive that has left one man dead. 

According to reports, police arrived at the scene around 7:30 on Friday night and found a man unresponsive on the driveway.  They said he had been shot.

Police said 32-year-old Brice Wade Boudreaux had reportedly arrived at the Conroe home and attempted to take his two children.  The home belonged to his estranged wife’s grandparents and she had living there for the past five months.

Jesse Berwick, the owner of the home, allegedly would not allow Boudreaux to take his children.  He ordered Boudreaux to leave his residence.  Boudreaux reportedly refused to leave and pushed Berwick out of his way.

Police were told that 80-year-old Berwick then got his gun from another room. When Boudreaux reportedly still refused to leave, a shoving match ensued on the homeowner’s driveway.

It was during this time that Boudreaux apparently struck Berwick in the chest where his pacemaker had recently been placed.

Berwick told police that he felt his life was threatened, and he reportedly fired the weapon, striking Boudreaux in the torso area.

Boudreaux was pronounced dead at the scene. 

Police are still investigating, and the Montgomery County DA will decide if charges will be filed.
