La Marque wants to block release of drowning victim's 911 call
10:50 AM CDT on Wednesday, May 14, 2008
LA MARQUE — City officials have asked the Texas Attorney General’s Office to block the release of a 911 audio recording of a wreck-related drowning, citing the family’s wishes and litigation fears.
The drowning victim’s father, however, told The Daily News on Tuesday he would like the newspaper to have the recording.
Ronnie Sanchez said he doesn’t want the newspaper or broadcast media to air the 911 call, but does want The Daily News to hear the recordings, which could reveal whether police dispatchers handled the situation appropriately.
Kristen Anet Sanchez, 20, of Galveston, lost control of her car April 26 and hydroplaned off state Highway 146 near Highway 3 into a pond, Texas City police said.
As her car floated upside down in 4 to 6 feet of water, she frantically called 911, but police said she was unable to tell dispatchers her location.
Both La Marque and Texas City police dispatchers spoke to her.
Ronnie Sanchez said he went to Texas City police and listened to his daughter’s desperate situation.
The Texas City tape lasts about nine minutes, he said.
He has not heard his daughter’s conversation with a La Marque dispatcher.
“I would like some investigation to be done ... I didn’t want to listen to it, but I had so many conflicting reports from detectives and officers. It’s not matching up,” he said.
In a letter to The Daily News, La Marque City Attorney Ellis J. Ortego, asks Texas Attorney General Greg Abbott to block the release of the tape because, “providing an audio tape of a person in the process of drowning serves no legitimate public purpose.”
Ortego said the interests of Sanchez’s family overcome the presumption of the Texas Government Code that the information is public.
Ortego also said that although litigation has not been brought against La Marque, “it is very possible that suit may be brought alleging the deceased drowning was caused by the negligent acts or omissions of the La Marque Police Department.”
Ortego said it has been reported that Sanchez’s death might have been prevented had first responders found her sooner.
