Woman slammed by uninsured ambulance

11:36 PM CDT on Tuesday, September 25, 2007

By Jeff McShan / 11 News

Alice Torres shows 11 News photographer Greg Hamilton where her new car was rear-ended by an ambulance four months ago.

Damage that had to be repaired by her insurance company because the private ambulance that collided with her was not insured.

The ambulance that hit her belongs to a company called 1st Alert. The driver of the vehicle was originally subpoenaed to court to tell his side of the story, but Torres said he failed to show up and there is now a warrant out for his arrest.

“I can only imagine that an ambulance that transports people that are ill would definitely be required to have insurance,” said Torres.

The owners of the company called 11 News to say they are saddened by what happened to Ms. Torres, but they wanted people to know that it was their insurance company that made a big mistake. That the insurance company failed to include the particular ambulance in question to the policy.

Their independent insurance agent, Richard Grice, sent us a fax that reads, “Even though they made an error, we are trying to correct the incident and solve all misfortune that Torres may have suffered.”

“I don’t think I can say, ‘Oh, I’m sorry, it was a fluke,’” said Torres. “(Or) I didn't know, I did not have insurance because I am required by state law to have insurance.”

While we have learned the Texas Department of Health has many regulations regarding paramedics and ambulance related insures, we found out that it’s simply the Texas Department of Public Safety that comes into play here.

Ambulances are required to have higher coverage, but every vehicle, ambulance or not, must be insured in Texas.
