SAN ANTONIO Montaye Anderson has a contagious smile. The 14-year-old eighth-grader at Legacy Middle School was born with a brain defect and has the ability of a 10-month-old.

Montaye smiles a lot, said Tiffany Anderson, the boy's mother. Anybody who's ever met him will tell you, you can't help but smile or want to hug him or touch him.

Anderson said her son was slapped in the face recently by an 11-year-old special needs student. On Friday, it happened again. He was allegedly hit by the same student during a physical education class.

I want the district to find special help for this child and to get him out of the classroom, because there are other children in the class, Anderson said.

A spokesperson for the East Central ISD released this statement:

We are aware of a situation that occurred 11-9-12 between two special needs students at Legacy Middle School. The campus and district administration will continue to work with the teachers, parents and students to implement a plan to resolve the concerns of safety.
