HOUSTON A wheelchair-bound man is facing charges after investigators say he beat an 88-year-old man with a cane and stole the victim s violin case.

George San Miguel, 53, is charged with injury to an elderly person.

According to court documents, the victim was playing his violin at an intersection in the 6900 block of Woodridge on June 1, 2012, when the incident occurred.

The victim said he had his violin case open next to him, and at some point, San Miguel rolled up, grabbed it and took off.

When the victim told San Miguel to stop, he said San Miguel told him to come and get it.

The victim followed San Miguel to an area behind a nearby Shell station.

But when he approached San Miguel to get the violin case, the victim said San Miguel grabbed the victim s cane and started beating him in the head and body.

The attack caused the victim to fall down, and he was taken to the hospital via ground ambulance.

San Miguel got away, police said.

Eight days later, however, investigators said the victim was riding in a car with his son through the same intersection when he spotted San Miguel.

The victim told his grandson, who called police.

Officers came to the scene and arrested the suspect.

Charges were filed that same day.
