HOUSTON A man died after he was shot by a deputy during a struggle in northeast Harris County Wednesday evening, according to authorities.

Harris County Sheriff s Deputy Michael Medina responded to a noise disturbance in the Tall Timbers apartments located in the 13100 block of Woodforest Drive around 8:20 p.m.

The deputy said he was approaching an upstairs unitwhen 33-year-oldCharles Roy Jr.opened the door and began to argue withhim.

Authorities said the two began to wrestle and fell down the stairs.Deputy Medinaattempted to Tase the suspect, but the device did not deploy properly. The suspect then took the Taser from the deputy.

The deputy pulled out his firearm andshot Roy once in the chest.

Roy was transported to LBJ Hospital in critical condition. He later died in surgery.

Deputy Medina was treated at the scene for minor bumps and bruises. He is an eight-year veteran of the force.
