HOUSTON -- It was a big win in civil court for residents fighting against the planned 21 story Ashby high rise at 1717 Bissonnet.
Jurors declared the building a nuisance for 20 residents who live near the planned building and ordered the developers to pay more than $1.6 million in damages.
Some residents were awarded more than $100,000 because of the building's impact on their property values and quality of life.
Ashby opponents will use the nuisance decision to ask a judge in January for an injunction to halt the project completely.
Developer Buckhead Investment Partners plans to appeal the jury's decision and will fight any effort to block the building.
If such a decision remains upheld, we are entering a dark era for urban growth and economic prosperity for Houston and the entire State of Texas, said the company in a statement.
It sets a dangerous precedent that any lawful, entitled and fully permitted real estate project may be affected by any similarly styled litigation.
