BRAZORIA COUNTY, Texas A medical examiner has ruled the shooting death of a driver following a Houston-area wreck that killed two young brothers was a homicide.

A corner issued the preliminary ruling in the death of 20-year-old Jose Ines Banda. Brazoria County sheriff s investigator Dominick Sanders said Tuesday that the report also indicated Banda, who was shot in the head, had alcohol in his system.

No one has been named as a suspect in the shooting just minutes after Banda s car hit a pickup truck being pushed by the children Friday night in Alvin. Authorities say 12-year-old David Barajas II and his 11-year-old brother, Caleb, were helping their father move the vehicle after running out of gas.

A message left Wednesday with the Harris County Institute of Forensic Sciences wasn t immediately returned.
