HOUSTON Seven Occupy Houston protesters who were arrested at the Port of Houston Monday are now out of jail.

Prosecutors charged the group with using a criminal instrument, citing the PVC pipes they used to protect their arms.

On Wednesday morning a state judge ruled the pipes were not criminal instruments and ordered the protesters released.

Charges were still pending against 13 other protesters.
