HOUSTON The sons of a dead firefighter are accused of defrauding the Houston Fire Department's pension fund.

Prosecutors said Matthew and Adrian Martinez forged documents to show they attended college, but they didn t. They collected $50,000 over six years.

Their dad Henry was off duty when he was killed by a drunk driver in 2005. Under pension rules, his sons were eligible for his death benefits only if they attended college full-time.

Both are charged with felony theft and face up to 10 years in prison if convicted.
