Family 'devastated' after baby killed in stroller; fault under investigation

ARLINGTON, Texas -- Friday afternoon, Chelsea and Daniel Bingenheimer clung to each other and cried at the very spot where just the day before, their sweet, smiling 7-month-old baby boy died.

"These parents are just devastated," said family attorney Jim Ross, who spoke on their behalf Friday. "We’re definitely going to pursue the civil liability and the claims we have against whoever is found to be at fault with this."

But we still don't know who is at fault, and we might not for a while, according to Arlington police.

What we do know is two cars, traveling opposite directions on South Cooper Street Thursday morning, crashed at the intersection of California Lane. One of the vehicles ran into a sidewalk median, killing baby David and injuring his father, Daniel.

Police are now looking into traffic light data, however Sgt. Jeffrey Houston of the Arlington Police Department said the lights change at different times on different days at different moments. He said being able to figure out who had a green light at the moment of the accident isn't as simple as you might think.

"They're going to talk to the experts, the engineers," he said, "make sure the lights were working, see what kind of patterns the lights change in, and then they’ll have to go back and compare that with the data they’ve got from talking to witnesses."

In the meantime, Annette Love - who was a perfect stranger to the family until Thursday - has been collecting money for the couple's growing expenses. David's mother, Chelsea, is expecting another baby. Friday, Love gave them the $670 she's raised so far at Texas Automotive Paint. She said she will continue to collect funds at 1107 California Lane, Suite 319, until they stop coming in.

"They just cried and gave me a hug and told me they love me, and I said, 'I love you, too,'" she said of the family's reaction. "'I don’t know you, but I love you, too.'"

The family's attorney says the family is stunned by the outpouring of love and support from the community.
