Victoria bus wreck victim seeks justice

Bernarda Pena lost her right arm in the wreck.

HOUSTON -- Most people don’t remember the accidents they’re in - especially if they’ve been hurt.

Bernarda Pena lost her arm, and she said she remembers everything.

It was 2 in the morning on Jan. 2, and Pena was on that bus that crashed near Victoria.

She remembers the bus swerving and then turning over on to its side.

“Everybody got up, but I can’t move, because the bus has come down,” she said. “Then something come on my arm, and I couldn’t move.”

Pena was pinned in.

“I saw the other lady was right here on top of me, and I couldn’t move,” Pena said.

With the windows shattered, the pavement was near her face now, and she could feel sparks as the bus slid on its side against the ground.

“I tried like to move my face from there,” she said. Then suddenly, the bus stopped moving.

“When I tried to see, I don’t have my arm,” Pena said.

Pena could only wait in the darkness.

“I only was thinking about God; God was with me and that’s it,” she said.

Rescue crews pulled all 47 people off the bus, and one passenger died.

Pena and 11 other passengers who were injured are now suing the corporations involved in this bus trip.

They all have the same attorney.

“We certainly think the passengers were subjected to a driver that was fatigued; there was possibly some problems with the bus,” attorney Terry Bryant said.

When asked to elaborate on possible bus problems, he would only say, “We’re very early on in our investigation.”

The suit can not replace everything Pena lost along with her arm.

“First my work and driving — I can’t drive now,” Pena said. She’s waiting for a prosthetic.

In the meantime, the former McDonald’s manager will now have to learn how to grasp what comes at her in life with her left hand.
