HOUSTON—The fight to prevent a high rise from being built in the South Hampton area may soon come to a close.

The Ashby high rise has drawn the ire of residents in the exclusive neighborhood since its inception.  Thirty of them have filed a lawsuit against the developer, even though the project has been scaled back.

Attorneys for the homeowners argued the high rise would create and diminish property values anywhere from 12 to 22 percent.

The developer, Buckhead Investment Partners, declined an interview, but in court pointed to the absence of zoning laws in Houston, as well as the fact the project has received a permit from the city.
