DAYTON, Texas –A 51-year-old man who shot his neighbor’s dog early Wednesday was shot by a Liberty County Sheriff’s deputy after pointing a rifle at the officer, authorities said.

Jimmy Hutchins was charged with attempted capital murder of a peace officer.

A deputy went to Hutchins’ home on FM 321 and Private Road 684 around 1 a.m. to question him about shooting the dog. When he knocked on the door, Hutchins opened holding a rifle.

Hutchins ignored commands to drop the weapon, then pointed it at the deputy, authorities said.

The deputy, fearing for his life, fired off several rounds. Hutchins was struck in the leg.

Hutchins was airlifted to Memorial Hermann Hospital and was expected to live.
