Grand jury clears Austin officer in fatal shooting

AUSTIN, Texas (AP) — Prosecutors say a Travis County grand jury has declined to indict a police officer who fatally shot a 70-year-old man after responding to a disturbance about a dog.

Authorities said Monday the grand jury heard about seven hours of testimony from witnesses in the March 2013 shooting. Jurors declined to issue any indictment against Austin officer Jonathan Whitted.

Resident John Schaefer had called 911 to report he had shot a dog that attacked him in his yard. Schaefer was asked not to be armed when Whitted arrived but Schaefer refused, saying he had a concealed handgun license.

When Whitted approached the home he found Schaefer armed and attempted to restrain the man to secure his handgun. Schaefer pulled away and aimed at Whitted, who then drew his weapon and shot Schaefer twice.
