SAN ANTONIO (AP) — A Texas appeals court has thrown out a 25-year prison sentence given an accused child molester who agreed to a plea deal after a San Antonio jury sentenced him to eight life sentences.
The offender, 52-year-old Israel Rodriguez, contends his inexperienced lawyer gave him poor advice that convinced him in 2011 to reject an initial 10-year prison deal.
The 4th Texas Court of Appeals, acknowledging the "unique circumstances" of the case, has returned it to the trial court with the 10-year agreement back on the table. The court says the timing puts it in "the position he would have been in prior to his counsel's improvident advice."
The San Antonio Express-News reports (http://bit.ly/1iwHlnx ) the case involves charges of sexual assault or indecency with two girls, 14 and 16 years old.
