HOUSTON (AP) — A judge has declined to stop a man from taking his seat as an elected official even though he's accused of misrepresenting his race to voters and is being sued for allegedly not living in his district.
Dave Wilson was expected to attend the Houston Community College board of trustees meeting Thursday.
The Houston Chronicle reports (http://bit.ly/1apv4PJ ) state District Judge Brent Gamble on Wednesday declined to grant a restraining order preventing Wilson from sitting on the board while the lawsuit is pending.
Harris County Attorney Vince Ryan contends Wilson can't serve because he was not living in his district when elected.
Wilson's opponent alleged mailers Wilson sent to voters in the predominantly black district implied Wilson was black. Wilson, who is white, has said he never lied on his mailers.
