EL PASO, Texas (AP) — A West Texas jury has sentenced a man to 40 years in prison for the 1977 killing of his stepfather, a case resurrected after his brother told authorities he confessed to the crime.
The jury in El Paso took about two hours Tuesday before sentencing 55-year-old Roger Garrett, who was found guilty of murder the day before in the slaying of Army Maj. Chester Garrett. The Green Beret's body was found in his car in the desert east of El Paso.
Garrett's brother, Patrick Garrett, told authorities earlier this year that his brother had admitted to killing Chester Garrett. Roger Garrett's attorney told jurors that Patrick Garrett only accused his brother and their mother, Lisbeth Garrett, after they stopped supporting him financially.
The murder trial of Lisbeth Garrett is scheduled for early next year.
