AUSTIN, Texas (AP) — A Central Texas jury has sentenced a man to 13 years in prison in the 2010 death of his 2-year-old nephew, who was critically hurt while in his uncle's care.
The Travis County jury deliberated for more than two hours in Austin on Friday before arriving at the penalty for 26-year-old Mark Paniagua (pan-ee-AH'-gwuh). The same jury convicted Paniagua of murder on Thursday.
Prosecutors say Paniagua was babysitting Carlos de la Rosa and five other children when Carlos cried and kept asking to go outside and play. Authorities say Paniagua shook the boy and threw him into a room on a mattress.
Doctors say Carlos suffered blunt force injuries and died at a hospital.
Paniagua didn't testify during his trial.
