Baytown teen accused of killing baby in toilet to stay in custody

BAYTOWN, Texas -- The 14-year-old girl accused of stuffing her newborn baby down a junior high toilet will stay in police custody for another 10 days, a judge ruled Friday.

“Basic reasoning is the seriousness of the offense.  And one capable of taking a child’s life at that age under those circumstances causes us concern both for that individual as well as the public,” said Harris County Assistant D.A. Bill Hawkins.

On Thursday, the Cedar Bayou Junior High School student was arrested and charged with her son's murder. Baytown police say she showed no emotion and did not resist arrest. The eighth-grader is being held in a Houston-area juvenile detention center.

Investigators say that the infant, whose 14-year-old mother was a student at Cedar Bayou Junior High, died after he had toilet paper stuffed down his throat and was submerged in the toilet.

The autopsy also found blunt trauma to the baby’s head and neck.

It was that autopsy report and interviews that lead police to file charges against the teenaged mother, police said.

“It was very upsetting to everyone involved it was very upset I don’t think anyone that’s heard about it can keep from being sad,” said Kathy Clausen with the Goose Creek School District.

District officials say this entire ordeal has been rough on the students. About 15 of them have sought counseling.

Authorities say that they do not believe the teen told anyone she was pregnant, but they say she, herself, knew she was with child.

They also say bruising found on the baby’s neck was intentional.     

“To get to full term and not know is certainly more rare, but it obviously happens.  And we hear of young people that are in such denial and they eat a lot chips they’re not attune in with their body and they don’t know what’s going on,” said Meryl Cohen with Planned Parenthood.

“It’s a disturbing terrible time for the mother of the baby and the family members and all who are involved,” said Baytown PD Captain Roger Clifford.

Police say that the 14-year-old could be certified to stand trial as an adult, however, she won’t be eligible for the death penalty because she’s not 18.

11 News legal expert Gerald Treece says he’s never heard of a 14-year-old facing capital murder charges. “Here’s a girl that at 14.  She’s like most 14-year old ladies. She doesn’t have judgment that’s why she’s called a teenager. That’s why the juvenile justice systems handles this.”

The eighth grader will be back in court in ten days.
