Brandon Backe's lawyer: 'No legal or factual basis' for brawl charges

HOUSTON—A sergeant with the Galveston Police Department’s Internal Affairs Division and Astros pitcher Brandon Backe met at The Spot along the seawall Wednesday.
The pair, along with Backe’s lawyer, Bob Moen, were there to discuss a bloody brawl at the San Luis earlier this week that left Backe and eight others in jail.
Moen said Backe wants to restore his good name. He used a back door to get into The Spot, and Moen said he is not ready to make a public statement yet.
“He has fond feelings for the organization he’s been a part of for so many years, and he doesn’t want to jeopardize that simply because of the accusation against him, his ability to do that and stay an Astro,” Moen said.

Brandon Backe was among nine people arrested after a brawl with police at a Galveston bar early Sunday morning.
Backe is said to have a fractured nose, a black eye and facial bruises from the melee. The whole thing started after a wedding. Backe was in the wedding party, and he and others decided to celebrate at the H20 Bar in the San Luis.
One of the men reportedly tried to bring a drink into the bar, and a police officer stopped him. It went downhill from there.
Moen and witnesses claim police officers punched and kicked Backe.
Police say he was resisting arrest.
“There is no legal or factual basis for these charges. And I am not just talking about Brandon, who is my client, I’m talking about the adults who were Tasered,” Moen said.
Two men were Tasered during the brawl, one of whom was Life Flighted to a Houston hospital.
An eyewitness gave 11 News a video allegedly showing GPD officers using a Taser on the father of the bride.
Police have yet to comment on the video, but they say they are investigating.
The internal investigation could take some time.
Meanwhile, Moen said he may ultimately ask for a third party to come look at what happened – possibly the Texas Rangers or the U.S. Attorney’s Office.
“With all due respect, I would feel much more comfortable if there was an outside agency doing this investigation,” Moen said.
Police said some of the charges resulting from the brawl have since been dropped.
Moen said he hopes to have his client’s case resolved soon.
