HOUSTON – The Harris County District Attorney’s Office has named a special prosecutor in the case of an Houston Independent School District principal charged with misdemeanor shoplifting.

The special prosecutor was selected because Tammie Daily’s daughter is a prosecutor in the Harris County DA’s office, so they wanted to avoid a conflict of interest.

Daily, a principal at Shadydale Elementary in northeast Houston, was arrested and accused of shoplifting on Dec. 1 and also banned for life from Macy’s. She said it’s all a misunderstanding.

Her attorney said Daily came to the Memorial City Mall store to return some pants and while that was happening, she picked up some items including commemorative Christmas ornaments and a Polo cologne set. Daily said she left the store and realized she hadn’t paid just as store security came up. She said the manager offered to let her pay, which she did, but police arrived and arrested her.

The value of the merchandise in question was $350. Daily's attorney said Daily has never even had a traffic ticket.

She made an appearance in court on Tuesday.
