Father: Son was unarmed when neighbor shot him to death

TAYLOR LAKE VILLAGE, Texas – A father in Taylor Lake Village is demanding answers after his son was shot to death while walking his dog early Sunday.

Brandon Smith, 36, was unarmed when he was shot in the Timber Cove subdivision, according to his father.

"He had nothing with him but a dog and a leash," Stanley Briers said. "I’d like to know what they’re thinking. What were they thinking when that happened? "

Briers said he found out his son was dead when he received his first condolence call from a neighbor, hours after the shooting.

"Told me that Brandon had passed away, and I said, ‘Brandon’s here,’" Briers said.

He didn’t realize that his son had gone up the street to a crawfish boil late Saturday or early Sunday, and was kicked out.

Lakeview police say Smith returned to the house in the 800 block of Shorewood Drive with his dog around 4:30 a.m. Sunday. The owner called 911 when Smith refused to leave.

With a gun in hand and a dispatcher on the line, the homeowner said he ushered Smith out into the street. He claims Smith lunged at him, so he shot him three times.

No charges have been filed, but the investigation continues.

Smith had a history of arrests for dwi, criminal mischief and resisting arrest, according to records.

"I do not understand how you can shoot somebody dead in the street, no matter what your story is, and nothing happens," Briers said.

Briers said police have yet to ask for his side of the story or to explain why they never contacted him when they discovered his son’s body. He is also concerned because, he says, a toxicology test was never performed on the shooter.

11 News reached out to the homeowner, but no one answered the door Tuesday.

Homicides are rare in this small town near Clear Lake. In fact, it’s been decades since the last one.
