Confessed child molester let go by police

HOUSTON—If a bank robber had an epiphany and called police to confess he just robbed a bank, it stands to reason there would be a quick arrest. 

But in the case of a Houston man who confessed to sexually molesting two girls, including his own daughter, there was no speedy arrest. There was only anger and confusion from the victims’ relatives.

There was also outrage from child advocates, who called the case the tip of a troubling iceberg. They believe the justice system treats sexual assaults of children far less seriously than other "equal" crimes on Texas law books—crimes like aggravated robbery, kidnapping and even murder.

But even more troubling to those advocates is how slow police processing leaves possible pedophiles on the street, awaiting arrest and possibly offending again.

For example, last June, a woman went on her husband’s computer and saw child pornography being downloaded.

(Note: 11 News has chosen not to reveal the identities of the parents or the suspect, as that may reveal the abuse victims’ identities by association.)

"My world turned upside down," said the woman.

But it was about to get worse, because she said she asked her husband if he had done anything more.

"And he said yes, he said that he had touched our daughter," she said. But she said he also claimed it had been a fully clothed molestation.

Scared and confused, the mother took her kids and left him, uncertain if she should tell anyone. Then, a few months later, Christmas came around. The estranged husband was staying at the home of long-time family friends. They, too, had a 9-year-old daughter.

"She said, ‘Mom I’ve got to tell you something,’" the girl’s mother said. "Something happened in the middle of the night."

Their daughter remembered the man crawling into her bed and taking off his pants.

"I was shocked and hurt," said the mother.

"I did not know how to react. I started shaking," said the father. "I wanted to attack the guy. I wanted to kill him."

And then something surprising happened. The suspect confessed—right away—to family and friends, and also to police. In fact, a Harris County Sheriff’s Department incident report states "the suspect reported he sexually molested two girls."

But what happened next has troubling implications about how police are handling child molestation cases, and if, in the process, they are endangering other children.

Even after his confession, police let the suspect go.

"I was livid," the suspect’s estranged wife said. "Are you kidding me? This makes no sense."

Even worse, her daughter then began to open up.

"Finally she broke down and she told me everything, and it was horrific," she said.

According to her daughter, it was more than just touching, but unclothed acts that even included attempted intercourse.

When police interviewed the girl, the mother said they promised an arrest in a few days, but it didn’t happen.

"A week goes by, a week and a half goes by, two weeks," the mother said.

She said investigators made promise after promise, but the suspect remained free.

In fact, she said the lead investigator on the case told her "it can take up to nine weeks to get someone arrested."

The mother was outraged, and so the next time she called him, she recorded the conversation.

First, Harris County Sheriff’s Sergeant James Fitzgerald blamed his caseload.

"I’ve got a hundred of these things that I’m actually working on literally, and there’s no way you can work ‘em with any kind of consistency and keep up," Fitzgerald said.

But what about the fact the suspect actually confessed?

Sgt. Fitzgerald: "You can’t turn yourself in for a crime that hasn’t been charged yet."

Mother: "Huh?"

Sgt. Fitzgerald: "Unless it’s a homicide or something."

Mother: "You can’t go to police and confess that you committed a crime?"

Sgt. Fitzgerald: "Not this type."

Confused? Randy Burton sure is, and he’s a former Chief Prosecutor for the Family Offenses Division of the Harris County District Attorney’s Office.

"I cannot for the life of me understand it. It’s inexcusable," Burton said. "There’s no difficulty here. We’ve got a child’s statement, and we’ve got the confession, it’s a slam-dunk case."

Burton, who founded the child advocacy group Justice for Children, said if police are letting suspects walk free for as much as nine weeks, it poses a real danger to the public.

"People who sexually assault children can’t help themselves from assaulting other children," Burton said.

That risk was apparent when 11 News visited the suspect in this case, who was staying at a home in northwest Houston with children living nearby.

So what did the lead investigator have to say?

11 News: "What took so long to make an arrest in this case?"

Sgt. Fitzgerald: "This is one of the many cases we’ve got and, we have to prioritize them."

11 News: "So even with a confession that didn’t prioritize it?"

Sgt. Fitzgerald: "That actually would make it slightly lower because he’s not a risk to anybody."

11 News: "How can you be so sure he’s not a risk?"

Sgt. Fitzgerald: "Well, everything is an estimation."

 "I’m appalled," Burton said. "I think anybody who hears this story should be appalled."

The former prosecutor said he doubts this is the only case police have handled this way.

"I worry about how deep it goes," Burton said.

In the end, the suspect was finally arrested, six weeks after he confessed. But so far, he’s only been charged with sexually abusing his own daughter and not the second victim. Harris County Assistant District Attorney Denise Oncken said it was because the girl didn’t disclose what happened during a videotaped interview with investigators.

But Burton said the law is clear—she doesn’t need to. As long as she made an outcry to an adult, (which her parents said she did), the adult can testify in court.

"That is sufficient to make a case," Burton said. "There’s no reason, with the evidence that they had, that they couldn’t have gone forward."

why did the mother get scared packed up and left without reporting him to the police when it happened is beyond my belief,why wait and let him molest a family friends daughter? she needs to be examined.wake up lady what in the world were you thinking? turn the sorry p.o.s. in when it happens ,don't wait for months to say something.

Maybe the HCPD was too busy with their speed traps. And don't be too sure about the quick response to a bank robbery. Granted, this is a different agency, but there was one here in Clear Lake about six months ago, and it took HPD 30 minutes to arrive on scene.

Well as a mother my self and a former victim myself I understand the torment that these 2 familys are going thru. My attacker was never punnished for what he done. But there are ways of coping with such horrible experinces I hope they are seeking such help anlog with pushing for the B***erd to be put under the jailhouse. This seriously makes me wonder if Sheriff Fitzgerald isn't somehow in on being a pedophile himself and he's giving his fellow diddlers a break. This man's job is to know the law about child complaints and he seems to know little or is just pushing paper to help out his fellow man. Why does this guy who is in charge and has this huge case load not know the laws behind the system he is the face of? Why is it ok for this creepy man to have these guys out on the street? 'He poses no problem." then let Fitzgerald's granddaughter go stay the night with him.

Jeremy Rogalski and Channel 11 are to be commended in reporting this tragedy. Where are the other media on this? If there is a major collision on the freeways, without even loss of life, all are there with there trucks, and infobbabes. Something like this is of much more import to the public at large. How many pedofiles live in the Houston area. Thousands. I used to work at the prison and know that they all wanted to be paroled to Houston or Dallas. Why? For work? Yes; their work is finding one victim after another, and being undetected. Not being followed in a big city like ours is a certainty. Ask Sgt. Fitzgerald or parole officers. Thanks again to Rogalski and Ch 11 for bring this to light. We hope they follow up on developments as warranted.

. I have a dream. I win the Lotto. I now have a lot of money at my disposal. I get on the internet and identify sex offenders in my community. I methodically begin abducting them. I am not worried about being caught in this due to the fact that sex offenders are not affiliated with anyone other than criminals. Not family. Not law abiding community members. They are connected to no one other than their victims. I now transport them to an isolated island where they are deposited like the refuse they are, never to be in contact with decent humanity again. Only those that share their perversion. I just need to get those six lucky figures.

Fitzgerald may be over-loaded and hamstrung by the law, but let's look at what he said on tape. He said that this guy was not a threat because he confessed. Anyone in law enforcement, and just about everybody else who pays attention, knows that a child molester is a repeat( and repeating) offender. Period. In other words, this guy will commit his crime again. The only way he can be prevented from it is to be locked up. Fitzgerald owes it to the public and to the perp (to make sure he isn't killed by an outraged parent) to lock him up. He is derelict in his duty in not doing so. I am appalled that this pervert is still at large. Do you know how screwed up these kids end up when victimized by a monster like this. Meanwhile, you and I are being stopped repeatedly by HC constables for doing 40 in a 30. If anarchy becomes an option, it is facts like these, and officials like these that are RESPONSIBLE!

isleofskye77, kudos to you for your strength of character and your understanding of the position the police are placed in. I doubt I could be as strong as you. Child predators/molesters are sick lifelong...I honestly don't believe their particular form of mental illness can be successfully treated. If they are free and unsupervised, they WILL reoffend, time and time again. I sincerely hope you and your child...and any/ALL victims of this man...can get past this and not let it adversely affect the rest of your life. You are strong, and you CAN get past this!

Not referring to this case but for the comment that says that Children Do Not Lie about Child Abuse. I'm sorry, but they do. I know someone who lied when she was very young at the encouragement of her mother. The childs father was jailed, humiliated, made a black sheep of the family, just to have his daughter come forward when she became a teenager to say that she lied. Too little, too late. Her father is forever a member of the sex preditor registery or whatever it is and was never able to be a father to his daughter because of the so called mother. Children will lie which makes it bad because it will cause alot of these cases to not be taken seriously.

KHOU seems to have a love affair with Randy Burton. Whenever there is something to do with children and sexual abuse he is chosen to be KHOU's spokesperson. This concerns me because Randy Burton and his group Justice for Children has dysfunctional elements in its view of life. Hence perfectly good and loving parents have been denied the lives of their children after Burton Throws his materially wealthy cadre of lawyers at the alleged perpetrator. This is mosyt trajic because Burton rejects the existence and credibility of one of the most insidious forms of child abuse today, that being Parental Alienation. Ask me my daughter and I are among his victims. His group is nothing but a group of confused people that purport to be doing good work. In my case they failed my daughter and I miserably.

This is just one of many cases that gets nothing done!! My neices are in the same battle by their mother and her boyfriend yet they are running free and not behind bars!! this is an outrage something must be done about all this!!! I feel for these kids that have to live with this drama!!

You know alot you are blaming the police for not doing anything, but everything goes back to the DA. A lot of times they will not take charges without physical evidence. This is something that my husband (a police Officer) complains about all of the time. Some of the cases fustrate him very badly, but his hands are tied unless he can find enough evidense to get the DA to take the charges.

Reading this I am deeply sadden. My child was sexually abused and recently disclosed the abuse to me. Contrary to what may people think CPS jumped on the case did their investigation and has now fowarded it to Sgt Fitzgerald in December. I have called my CPS caseworker several times to touch basis with her and inform her I have not heard from the Sgt and she basically said there is only 1 harris county Sgt that works CPS cases and they go by priority so it can take a couple of months. My child did the right thing by telling me, I know there is a huge chance nothing will happen to the person that did this to her because there is no physical evidence but how could this be. How could they let this person run the streets without bringing them and conducting an investigation. One thing I learned throughout this entire ordeal CHILDREN DO NOT LIE ABOUT SEXUAL ABUSE, bottom line. This disgust me, I have no faith in our justice system. For now I can just wait for a call frm Sgt Fitzgerald!

i understand the anger but i dont understand why everyone is so surprised. this happens everyday. do any of you watch to catch a predator on msnbc? these guys will drive 5hrs to be with an underage child and then in court they are sentenced to 30days in jail or probation. this is happening everyday/everywhere and its never been high on the priority list for cops and thats not just here in Houston. it's everywhere and its truly sad. WE must protect our children. there's not many women you can talk to today that havent experienced this including myself. i was sexually abused for yrs by my step father. i honestly believe its such a low priority not only bc it doesnt generate revenue but bc the justice system is ran by mostly men and most men dont understand the affect molestation has on a child (not all men). they dont understand that it stays with the vicitim for life. i may be wrong but thats the conclusion ive come to after seeing this happen so often with no punishment invloved...

I can betcha one thing, if this has been one of these officers daughters that had been molested it would have not even taken 6 minutes, let alone 6 weeks, to have picked this scumbag up. Shame on the police, this man could have really hurt a little girl and then it would have really been too late, you cannot give a little girl her innocence back, NEVER.

Now would be the time for people to CALL THE SHERIFF and make it clear to him that adequate resources should be allocated to these cases. Furthermore, CALL THE DA and demand that that office move the cases through the system. VOTES ARE THINGS POLITICIANS UNDERSTAND.

This "Sgt. Fitzgerald" is long overdue an indefinite leave of absence. It is horrible to read his "rational" about prioritizing (for up to 9 weeks - and just where did that number come from ??) a slam-dunk case of child abuse. This one should have been so easy for his department - and....best of all, they could used a successful case resolution and screamed PR -- from the front pages of every TX newspaper....A suspect could be long gone to Tahiti by the time his/her arrest rolls around for child abuse, or so it seems. This is the worst example of police work. How many others are they neglecting? For me it would be simple, you touch/harm my child and you're gone.

I'm not surprised. A few years ago,My wife and I had to cut our vacation short after recieving a call from my sister saying I needed to come quick, we did. Once at home she informed us,that she had caught her husband molesting thier daughter 4 yrs.old. She reported the situation to Pasadena Police,They told him, that he better go stay some where else cause his wife was going to kill him, and that's all they did.The next day,I went to his job, I asked him if what my sister had said was true,He replied, yes it's true! I wanted to kill him right were he stood, But, I just looked at him right in the eye,and said, don't come back to the house,Ever! He knew very well what I meant. We haven't seen him since.

This is so full **&(%(. I have a friend whose father was prosecuted for molesting a young child at a walmart a few years ago. It was all over the news. In this case the child was sent to the restroom as the mother continued to check out at the register. In the restroom the walmart employee raped the child. The child ran out of the bathroom after the incident and told his mom. The employee left his shift and went home. That afternoon the police showed up at his residence and arrested him. He was in jail by the end of the day and stayed there until he was prosecuted. In this case his family was devastated and shocked and so was the victims. Walmart was sued and the man has been locked up since. What I want to know is why was there no hesitation here in sending this man to jail? Personally I would have just tortured him slowly until he begged me to kill him.

This does not surprise me...HPD will not file charges unless the child complains. My teenage daughter was being hounded by older men, even writing her from prison. I called several times to file charges but was told "teens will be teens and just kick her out of the house, that is what I did," the HPD dispatcher said. He also said that unless she complains that my complaints mean nothing.

This same thing happened or is happening to a friend mine. She married this guy when her daughter was about 3 years old. She is now 15. The mother left the stepfather and divorced him about 2 or 3 years ago because he was a "f" up. The mother and kids (2 are his) moved out of town. The mom and this guy were going to get back together. She was packed and ready to move here when her daughter left her a note and explained what this man had done to her. Her mom asked how long was this going on and the daughter said since I can remember. The mom was outraged and hurt. She called the houston police and they recorded him confessing to the mom and he is still a free man. Believe it or not, he is actually a school teacher. What a shame. The little girl wants justice and so does the mom.

This is an outrage...don't have enough task force to work on it? Why? Too busy giving traffic tickets? Too busy arresting people for non-violent crimes like walking on the wrong side of the roadway, possession of marijuana, etc., etc.??? Wo be it unto someone to commit an act like this against my daughter. Scum like this doesn't deserve to see the light of day, and anyone who protects scum like this by looking the other way and ignoring it in the process is no better!!!

It’s just so sad that predators can actually get away with this kind of thing; they don’t understand that this scars kids for life, then we ask our self’s why our kids do the things they do, why do they blow up schools, why do they kill, well this is why because the ppl who are supposed to take care of them are turning them into it. The wheels have fallen off of the system. Legislators are more concerned with proffesional atheletes taking steriods and defining who can marry whom, than dealing with the real problems. We can't house all the people we convict now, and yet the "feel gooders" want to make even more things criminal. Eventually the breaking point may be reached and anarchy will be the law of the day. I hope it doesn't come to that, but the fact is that people are stressed beyond that point already. Like it or not, we are to blame. We spend so much time arguing that we can't get anything accomplished. Take a look around the extremist of both parties has taken over, anyone that is moderate is labeled a flake...Some need to wake up and smell the coffee. Every day we stand to lose even more control than we already have. This story is but a symptom oif a much larger problem.

What if he would have committed the act right in front of their ( the cops ) face? Does that mean it's out of his system and he no longer poses a threat to anyone else? What kind of statement was that?I can't find the words to describe the agony I feel for these children and the parents. I was a victim of this discusting crime for many years. Because I could not sit in front of a courtroom full of strangers, with the jerk sitting right in front of my 5 year old self, and explain in FULL detail what he did to me, he only went to a troubled teens home til he was 18. He was 17 at the time!!!!!! I am now 37 and it has only gotten worse!!!! God help us.

Let me clarify some things here, Sgt. Fitzgerald is most definately overworked! It is not him we are putting the blame on it is the laws that put him in that position. What should have happened in this situation is they should have arrested him and let him sit behind bars while they were doing the investigation because he confessed. The biggest difference is that he did confess! I could understand a little delay if he denied it because of too many cases of false claims. My hope is that we can change that and get more people working on these sort of cases. Considering the seriousness of this type of crime I would have expected there to be more people in this division. The fact that he had so many cases to work on is rediculous!!! He also stated that if he is absent then no one else is allowed to touch his cases, so if he gets sick the criminals get more free time. By the way if you haven't kept up with the comments, I'm the mother in this story who called in the first place.

The true blame lies with the Sheriff Dept. for not assigning enough investigators to this division, their case load is huge, no one could work it all. The same thing goes on in the Houston Police Dept., not enough investigators for the number of cases. Each investigator will have approx. 100-150 active cases and these cases take many hours/days of investigation each. The case load is more than a person can physically work, their just aren't enough hours in the day.

here's a story about the cops NOT doing their job. I had taken a window ac unit to the car wash to clean it. When I got home, I placed it on my driveway by my house in front of my wife's car. I did this so it could dry out before I put it back in. The next day while I was at work, a derilict looking guy knocked at the door, my wife chose not to answer. She watched him walk over and pick up the unit and start to take out to the street and load it in his car! She called the cops and when the cop arrived, you know what he said? "Well, what do you want me to do, he knocked on the door." I guess if the man had raped and killed my wife it would have been OK, after all, "He knocked on the door." The cop took one look at him and decided that it would cost time and money tp prosocute this man for theft....

When I saw the promo for this I was hoping it would draw attention to the HUGE caseload the depuites are working. It is insane that one person should be expected to work 50-100 child abuse cases. Sheriff Garcia needs to give this the priority it deserves. Send them some help!!!!! The cases have to be worked correctly or the pervert will be arrested but NOT convicted in court.

everyone here is blamng the police..but what you do not understand is the police have to work under the laws passed by our wonderful state/federal goverment and sometimes those laws stack the cards on the criminal side...there are only certain crimes that police can arrest someone when they confess to a crime...read texas code of criminal procedure chapter 14...then there are case laws related to the same circumstance...and the police have to follow all these laws...sgt.fitzgerald comments were taken out of contexts...all these cases are top priority cases that are throughly investigated, to get a good conviction on the suspect..if a quick arrest was made and the case thrown out,then everyone would be blaming the police for thier sloppy work they did....in the end the da's office is the ones really running the investigation,not the police, the da's office wants more evidence than a simple confession from the suspect and the da's office also decides when an arrest warrant will be issue

You have to understand, the justice system, is now driven by money. The police are less likely to arrest somebody for property crimes or crimes against persons because it costs the sytem to prosocute, convict and store the offenor. Traffic tickets generate revenue, as do most minor offenses such as misdomeanor possesion. Fines, court costs and probation fees all are poart of the revenue stream. But a pervert...Do you realize just how much it costs to prosocute one? Add to that the number of false claims...But this is just plain wrong! This pervert confessed!

If they let him go free after abusing a white child, you know there are dozens running around free, who abused Black or Hispanic children!!!! The girl did not repeat what she said on tape, because she did not say it the first time! if you were the father and you daughter told you that a man, got in her bad, without pants on, there would be no I wanted to kill him, he would have been severely beaten, so I have trouble with that!!!! 9 of 10 reported incident of child molestation do not make it passed a grand jury because there is no evidence other then an outcry statement, child or not, people find it very difficult to convict, so prosecutors are reluctant to pursue those cases, especially if they can't get a confession or extort a defendant into a plea!!! I had a client who sat in county jail for more then a year before the DA dropped charges on him, because they had no evidence other then the story told to police by the scorned ex-lover and her 12 yr old daughter!! Children do lie!!!

I'm the mother of one of the victims and I really appreciate all your comments. It ran through my head many many times to take the law into my own hands believe me. But, then the wrong person would be behind bars and I wouldn't be there for my daughter when she needs me most. I hope and pray that this can be fixed and all of the parents out there can breath a little easier. Jeremy did a fantastic job and has said that he is going to continue to try to get this fixed. Our justice system is broken, don't you know. In our country the criminal element is encouraged and many times actually rewarded. Look at our obsolete bonding system. The system is obsolete and broken.Our children are, or should be, our most valued item, but that isn't the case.
