HOUSTON – The sons of a dead firefighter are accused of defrauding the Houston Fire Department's pension fund.

Prosecutors said Matthew and Adrian Martinez forged documents to show they attended college, but they didn’t. They collected $50,000 over six years.

Their dad Henry was off duty when he was killed by a drunk driver in 2005. Under pension rules, his sons were eligible for his death benefits only if they attended college full-time.

Both are charged with felony theft and face up to 10 years in prison if convicted.
