CHARLOTTE, N.C. -- Ermilio Saragosa was trying to hand out cool treats to children in northeast Charlotte when he was confronted by a group of unruly teens on June 8.
They assaulted the 40-year-old ice cream man and recorded themselves doing it, then posted it to YouTube.
“They are trying to intimidate the guy who is out there trying to make a living, anything like that we take as seriously as anything else,” said Sgt. Rich Tonsberg of CMPD’s North Tryon Division.
The assault occurred at the Maple Run Apartments, which is located on Canterwood Drive near North Tryon.
The YouTube video went viral long before the crime was reported to police, but over the weekend investigators used the video and identified the suspects.
"Officers recognized the area and were able to locate the victim that was assaulted and make an arrest on two of the subjects... the reason we did that was because the posted it on social media," said Tonsberg.
The lone adult arrested was 16-year-old Daishaun Burney. He was charged with common law robbery and is in jail under $50,000 bond.
Police also arrested one of the girls depicted in the video; she’s a juvenile so none of her information will be released.
"A family member noticed one of the suspects and brought her down to the police station. When it becomes viral like that and a lot of people see it everybody knows somebody."
Since the assault, Saragosa has not returned to the neighborhood to sell his cool treats.
Burney had his first appearance before a judge Monday afternoon; he was given a court-appointed attorney and bond hearing date of July 16.
