Man convicted in drunk-driving crash that killed Dickinson woman

LEAGUE CITY, Texas — A jury Thursday began deliberating punishment on the intoxication manslaughter conviction of a man who had two prior drunken driving convictions, court officials said.

The jury of six men and six women deliberated about four hours Wednesday and Thursday before finding Anthony Lester, 44, guilty in the Aug. 15, 2007, drunken-driving death of Donna Lee Banduch-Lawson, a court official said.

Galveston County prosecutors Lester Blizzard and Rebecca Russell and Lester’s defense attorney, Michael Pena, presented closing arguments Thursday afternoon in Lester’s punishment hearing.

The results of that hearing, in which a friend and neighbor testified on Lester’s behalf, weren’t immediately known.

During questioning of two of Lester’s witnesses, Blizzard asked whether they were aware of Lester’s two previous convictions for driving while intoxicated and whether they knew another drunken-driving arrest was reduced to reckless driving.

Both men testified they never knew Lester to have a drinking problem.

Testimony in Lester’s trial in Judge Lonnie Cox’s 56th District Court began Tuesday and revealed how police found Banduch-Lawson dead at the scene.

A witness testified Lester abruptly entered oncoming traffic along a two-lane, rural stretch of FM 646 just west of South Shore Boulevard.

The force of the head-on collision, in which police estimated Lester’s car traveled at 88 mph, crushed the engine compartment of Banduch-Lawson’s car, trapping the Dickinson resident inside.

First responders were unable to free her from the wreckage to attempt cardiopulmonary resuscitation, testimony revealed.

League City police officer Jake Busard testified Banduch-Lawson’s car, which was traveling about 55 mph, came to a complete stop and was propelled backward at 27 mph. "That change of speed in two-tenths of a second is not survivable," Busard said.

Lester’s blood, taken about three hours after the crash, measured an alcohol percentage nearly three times the legal limit of .08 percent, testimony revealed.

Well well well, look how everyone is down talking and degrading someone they don't even know. I believe in second chances and accidents do happen. Not trying to justify the actions but not judging either. If you don't know the whole story or the people then you have no right to say anthing about the situation. God knows what he is doing and he has everything in his hands. So who are we to judge when God is the ultimate JUDGE. So let him do all the judging and we just sit back and not try to do his work. Who was there when this occurred most likely none of us so hello we cant say what really happened so we should just mind our own business and pay attention to whats going on with our own lives. It is just sad how we can talk about things and people we don't even know. Can't judge a book by it's cover........

I am happy to hear that courts are taking drinking and driving more seriously with stronger consequences - I lost a family member back in April 2006 and the driver was a repeat offender (3rd) and he was only given a $25,000 fine and 600 hours of community service. I know that him serving life in jail would not bring back my family member - but what a slap in the face to our family that this scum bag was not sentenced to jail time! WAY TO GO LEAGUE CITY - LOCK THEM UP AND THROW AWAY THE KEY!

Too bad they waited three hours for a sobriety test. Deaths caused by DWI are rarely prosecuted as severely as they should be.

I know it will never happen, but I'm for life in prison for a dirtbag who has been to court three times now for DWI related offenses. The POS had more than enough notice that his actions were placing others at risk. Had he pulled a knife out and killed the victim, we would be giving him 40 years in jail. Lock him up and weld the keyhole to his cell door shut...............
