GALVESTON, Texas -- A Galveston man has filed a lawsuit in federal court that seeks to overturn the state’s ban on same-sex marriage.

Domenico Nuckols, 60, is representing himself in the suit filed Tuesday in federal court in Galveston against Gov. Rick Perry and Texas Attorney General Greg Abbott.

Nuckols references a June 26 U.S. Supreme Court ruling that declared part of the Defense of Marriage Act unconstitutional, meaning the federal government can’t discriminate against married gay or lesbian couples when it comes to federal benefits.
