Judge in Tarrant County life support case recuses herself

FORT WORTH — A Fort Worth judge has recused herself from a lawsuit case filed by a husband who has asked the court to order John Peter Smith Hospital to remove his pregnant wife from life support.

Judge Melody Wilkinson filed the recusal Thursday afternoon, but didn't reveal why she stepped down from the case.

On Tuesday, Erick Muñoz filed the suit against the hospital on behalf of his wife, Marlise, who has been on life support since November. On Nov. 26, Mr. Muñoz found his wife unconscious on the kitchen floor of their home.The husband said doctors told him that same day his wife was brain dead.

Mr. Muñoz said it was against his wife's wishes to be kept alive by a machine, and Mrs. Muñoz 's parents have supported that thought.

However, JPS Hospital said state law requires them to keep her on life support since she's pregnant.

The suit filed by Mr. Muñoz argues that opinion and states since she's brain dead, Mrs. Muñoz "cannot possibly be a 'pregnant patient.'"
