HOUSTON – A 21-year-old man and his mother are facing charges after investigators say they seriously injured a 1-year-old child.

Dontae Donnell Smith and his mother, Sharlinda Brooks, are both charged with injury to a child.

According to court documents, Smith and his mother called 911 on September 16, 2011, after finding the baby unresponsive.

Smith told investigators he was brushing his teeth when he noticed the child sleeping on the floor. When he went to pick the baby up, he said the child was limp and unresponsive, so he ran out to get Smith.

He and Smith called 911, and the baby was rushed to Children’s Memorial Hermann.

Smith and Brooks both told investigators that they were the only people who cared for the baby, but that the baby had not suffered any injuries the night before.

Doctors said the child had serious injuries to his spleen, liver and chest that were indicative of forceful trauma.

Charges were filed on May 31, 2012.
