HOUSTON – Investigators have located the driver and passenger of a truck which fatally struck a man Monday outside a northwest Harris County movie theater, the Harris County Sheriff’s Office said.

Earlier this week, deputies released surveillance photos from the Silverado Movie Theater in Tomball where a man was fatally struck by a vehicle apparently after an argument over a movie. It happened after midnight in the 24700 block of State Highway 249.

Investigators said Michael Emerson, 23, and two of his friends went to the theater to see “300: Rise of an Empire.”  Emerson and his friends got into a verbal confrontation with two other men regarding the end of the movie and both parties exited the theater.  When the two other men got into their white Ford F150 Crew Cab Truck, Emerson confronted them from outside the passenger side door, deputies said.

Deputies said the driver of the truck put the vehicle in reverse, striking Emerson and knocking him to the ground. Emerson later died at a hospital.

The truck fled the scene, but deputies said they have now spoken with both the driver and passenger.

The Harris County Sheriff’s Office said the case will be presented to a grand jury for its consideration as to whether or not criminal charges should be filed.
